The services The Canus Group, LLC (hereinafter referred to as ‘TCG’) maintains through its Military Resume Wizard website are accessible to adults who consent to the following terms and conditions of use and any amendments posted on Military Resume Wizard site. Since TCG is not responsible for the content of any site linked from or linked to the Military Resume Wizard site, you are advised to review the particular terms and conditions of that site.
1. Scope of Agreement:
Unless indicated otherwise, this Agreement applies to the use of the websites which are owned, operated, or powered by TCG and our affiliates, including, without limitation, the Military Resume Wizard website and any other website that we may own, operate or power currently or in the future.
With the exception of subsequent amendments posted on the Military Resume Wizard site, this agreement constitutes the entire agreement between the parties and may not be otherwise amended, modified, or rescinded in any way except by a writing signed by both parties. No representations, statements or inducements, oral or written, not contained herein or in subsequent amendments shall bind either of us.
2. Membership Eligibility:
The services displayed on the Military Resume Wizard site are available to adults who can form legally binding contracts under applicable law. An adult is defined as an individual over the age of 18 or the age of consent in the jurisdiction from which the Military Resume Wizard site is being accessed. TCG shall consider all other individuals (i.e. clients under the age of 18 accessing our site) minors who must first obtain written permission from their parent or legal guardian prior to participating in the Military Resume Wizard website’s member-restricted services.
3. Member Conduct:
The Military Resume Wizard site is for the personal use of members, who agree to: (i) provide truthful information and abide by the terms of this Agreement and the Privacy Policy ; (ii) not permit others to use the Member Login Name and Password assigned to them in conjunction with their non-transferable Military Resume Wizard membership; and (iii) interrupt or attempt to interrupt the operation of Military Resume Wizard site in any way or to assist or authorize others in the reverse engineering of, decompiling of, and or disassembling of the software on the Military Resume Wizard site. Additionally, members are not permitted to distribute exchange, modify, sell or transmit anything copied from this site or as part of the coaching sessions for any business, commercial or public purpose.
A. Personal Information:
You agree to provide true, accurate and complete information as required by the Military Resume Wizard site Membership sign up process, including your legal name, address,
telephone number, email address and applicable billing information (e.g., credit card number and expiration date), and to allow TCG to share your information with third parties for the purpose of verifying the information you provide and billing your credit card or otherwise charging your account.
B. Charges and Fees:
You are responsible for all charges and fees associated with connecting to the Military Resume Wizard site, including all telephone access lines (including long-distance charges), internet service provider fees, telephone and computer equipment, sales taxes and any other miscellaneous fees and charges necessary to access the site.
C. Breach of Security:
Furthermore, you agree to inform TCG of any apparent breaches of security, such as loss, theft, unauthorized disclosure or use of your Member Login Name and Password or credit card. This notification shall be by one of the following means: (i) sending an e-mail to admin@MilitaryResumeWizard.com; (ii) by calling (702) 633-0044; (iii) faxing details of incident to (702) 889-0807 or (iv) by regular first class mail postage prepaid to The Canus Group, LLC, 5546 Camino Al Norte, Suite 2-186, North Las Vegas, 89031.
YOU, AND NOT THE CANUS GROUP, LLC, ARE RESPONSIBLE FOR YOUR BEHAVIOR AND THE BEHAVIOR OF THOSE WHO, WITHOUT YOUR AUTHORIZATION, USE YOUR MILITARY RESUME WIZARD MEMBERSHIP AND/OR CREDIT CARD.
4. Use of Website:
With respect to interactive parts of the Military Resume Wizard site, you agree not to post, send, transmit, upload or otherwise publish through the Military Resume Wizard site any materials which in TCG’s sole opinion (i) restricts or inhibits other members from using and enjoying said services; (ii) are abusive, defamatory, indecent, obscene, offensive or threatening in any way; (iii) encourage others to conduct themselves in a manner which would be considered a criminal offense or give rise to civil liability, or otherwise violate any law; (iv) violate another's copyright or other property right; (v) contain a virus or any other harmful component; and/or (vi) contain false statements concerning the origin of the material or the communication. You understand that all such communications which take place upon entering the Military Resume Wizard site are non-confidential and non-proprietary. Accordingly, you give up any claim that any use by TCG and/or the Military Resume Wizard site of such communications violates any of your rights (including but not limited to moral, privacy, proprietary and publicity rights).
While TCG does our best effort to employ industry standard practices in striving to protect your privacy on the Military Resume Wizard site, we cannot ensure or warrant the security of any information you transmit to us (or a linked site) over the Internet.
BY USING THE MILITARY RESUME WIZARD SITE, YOU RECOGNIZE THAT TRANSMISSIONS OVER THE INTERNET ARE AT YOUR OWN RISK AND THAT THIRD PARTIES MAY, DESPITE OUR BEST EFFORTS, UNLAWFULLY INTERCEPT OR ACCESS SAID TRANSMISSIONS.
A. Limitation of Services Due to Technical Difficulties:
Since TCG cannot control your ability to access the Military Resume Wizard site at any particular time, the services provided on the Military Resume Wizard site are on an "as-is, as-available" basis. The availability and use of the Military Resume Wizard site may be limited based on, but not limited to, the user’s computer platform, browser and operating system; installed software; availability and access to the required software necessary for running the application; and installed firewall and pop-up blocking software. TCG is not responsible for the member’s technical limitations in accessing or using the Military Resume Wizard site.
5. Termination & Refunds:
TCG will automatically, without further notification, terminate the membership of anyone who fails to abide by the terms of this Agreement, including any subsequent amendments. Payment made for the current membership shall be considered full payment. There will be no partial or prorated refunds.

A member who has abided by all of the terms of this Agreement, including any subsequent amendments, may seek to terminate the Military Resume Wizard site services and request a refund of all monies paid within the timeframe of their active membership and before the date their membership expires. (If your participation is being paid for or sponsored by a third party individual or institution this will not apply.) This request for termination of the Military Resume Wizard site membership and refund of monies paid must be in writing either by sending an e-mail to admin@ MilitaryResumeWizard.com, or by faxing the request to (702) 889-0807, or by writing a letter and sending it by regular first class mail postage prepaid to The Canus Group, LLC, 5546 Camino Al Norte, Suite 2-186, North Las Vegas, 89031. TCG reserves the right to attempt to rectify member dissatisfaction with the Military Resume Wizard site prior to issuing a refund of all monies paid. Termination and refund requests received after the Military Resume Wizard site membership has expired shall not be honored.
However, where the member's conduct has in any way violated the terms of this Agreement, including any subsequent amendments, or has prevented TCG and the Military Resume Wizard site from delivering the services as outlined in this agreement, then no refund will be issued to the member or individual or institution sponsoring the member. Additionally no refund will be issued due to technical difficulties in a member's ability to access the Military Resume Wizard site.
6. Privacy and Security:
TCG is committed to protecting your privacy and security. For more information, review our Privacy Policy, which is incorporated into this Agreement by this reference.
7. Indemnification:
You agree to indemnify TCG, its directors, officers, employees, agents, successors and assigns, for any losses, costs, or damages, including reasonable attorneys’ fees incurred by TCG and relating to, or arising out of any dispute pertaining to violations of the privacy policy, this agreement and any content or software placed on the Military Resume Wizard site.
8. Disclaimer of Warranties and Damages; Limitation of Liability:
THE CANUS GROUP, LLC SERVICES ARE PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR INFRINGEMENT. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
IN NO EVENT WILL THE CANUS GROUP, LLC, ITS DIRECTORS, SUPERVISORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE MILITARY RESUME WIZARD SITE, EVEN IF THE CANUS GROUP, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
IN NO EVENT WILL THE CANUS GROUP, LLC, ITS DIRECTORS, SUPERVISORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE MILITARY RESUME WIZARD SITE, WHICH RESULTS IN FAILURE TO OBTAIN RESPONSES, INTERVIEWS, JOB OFFERS, EMPLOYMENT, OR COMMUNICATION OF ANY KIND FOR ANY REASON.
NEITHER THE CANUS GROUP, LLC, ITS DIRECTORS, SUPERVISORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS NOR ANY OF OUR LICENSORS, LICENSEES, SERVICE PROVIDERS OR SUPPLIERS WARRANT THAT THE MILITARY RESUME WIZARD WEBSITE OR ANY FUNCTION CONTAINED IN THIS WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS WEBSITE OR THE SERVERS THAT MAKE THIS WEBSITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY PRODUCT, OFFERING, CONTENT AND MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THIS WEBSITE IS DONE AT YOUR SOLE RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH PRODUCT, OFFERING, CONTENT OR MATERIAL.
IN NO EVENT WILL THE CANUS GROUP, LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS, BE LIABLE TO YOU FOR ACTUAL DAMAGES FOR ANY CAUSE WHATSOEVER, REGARDLESS OF THE FORUM OF ACTION (WHETHER SOUNDING IN TORT, CONTRACT, OR OTHERWISE) WHICH EXCEED THE MEMBERSHIP FEES PREVIOUSLY PAID.
IN THE EVENT THAT THE CANUS GROUP, LLC COMMENCES ANY ACTION OR PROCEEDING AGAINST YOU BY REASONS OF ANY BREACH OR CLAIMED BREACHED IN THE PERFORMANCE OF ANY OF THE TERMS OR CONDITIONS OF THIS AGREEMENT AND/OR THE PRIVACY POLICY, OR SHALL SEEK A JUDICIAL DECLARATION OF RIGHTS HEREUNDER, YOU SHALL BE LIABLE FOR ALL COSTS AND EXPENSES, INCLUDING, WITHOUT LIMITATION, LEGAL COSTS AND REASONABLE ATTORNEYS FEES INCURRED BY THE CANUS GROUP, LLC IN ENFORCING THIS AGREEMENT AND THE PRIVACY POLICY. THESE AFOREMENTIONED COSTS, EXPENSES AND FEES ARE NOT SUBJECT TO COURT APPROVAL.
IF YOU COMMENCE ANY ACTION OR PROCEEDING AGAINST THE CANUS GROUP, LLC BY REASON OF ANY BREACH OR CLAIMED BREACH IN THE PERFORMANCE OF ANY OF THE TERMS OR CONDITIONS OF THIS AGREEMENT AND/OR THE PRIVACY POLICY, OR SHALL SEEK A JUDICIAL DECLARATION OF RIGHTS HEREUNDER, THEN IF THE CANUS GROUP, LLC IS THE PREVAILING PARTY IN SUCH ACTION OR PROCEEDING IT SHALL BE ENTITLED TO ALL COST AND EXPENSES, INCLUDING, WITHOUT LIMITATION, LEGAL COSTS AND REASONABLE ATTORNEYS FEES. THESE AFOREMENTIONED COSTS, EXPENSES AND FEES ARE NOT SUBJECT TO COURT APPROVAL.
SUCH LEGAL ACTION OR PROCEEDING SHALL BE BROUGHT IN A COURT OF COMPETENT JURISDICTION IN THE COUNTY OF CLARK, STATE OF NEVADA. THIS AGREEMENT AND THE PRIVACY POLICY SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEVADA, EXCEPT THE CONFLICTS LAWS. THE PARTIES CONSENT TO PERSONAL JURISDICTION AND VENUE IN NEVADA.
